Terms of Service

Oracle of Surf is a product of Stowcrest Pty Ltd (ABN 17 646 258 380) (“Stowcrest”, “we”, “us”, “our”). By creating an account or using Oracle of Surf (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

We may update these terms from time to time. Continued use after changes are posted constitutes acceptance of the revised terms. We will indicate the effective date at the top of this page when changes are made.

Oracle of Surf is a personal surf-session logging and analytics tool. It allows you to record surf sessions, manage your board quiver, view analytics and AI-generated insights, and access AI-powered features including Quiver Whisperer and Location Guide.

The Service is provided on a best-efforts basis. We do not guarantee continuous, uninterrupted access and may update, modify, or discontinue any part of the Service at any time with reasonable notice where practicable.

• You must provide a valid email address when signing up. You are responsible for keeping your login credentials secure.
• Access to the Service is approved manually. Creating an account does not automatically grant access.
• You must be at least 13 years old to use the Service.
• You may not create multiple accounts, share your account, or allow others to access your account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, scrape, or extract data from the Service by automated means.
• Upload or transmit content that is harmful, defamatory, or infringes any third-party rights.
• Abuse AI features in a way intended to circumvent usage caps or incur costs on behalf of others.

Several features of Oracle of Surf are powered by artificial intelligence (Anthropic Claude). AI-generated outputs — including surf condition assessments, board recommendations, and location guides — are provided for informational and recreational purposes only.

AI outputs are not professional advice. Do not rely solely on AI-generated content for surf safety decisions. Always use your own judgment, check local conditions, and surf within your ability level. We accept no liability for decisions made based on AI-generated recommendations.

AI responses may be inaccurate, incomplete, or out of date. The quality of outputs depends on the data you provide.

You own the data you enter into Oracle of Surf — your sessions, boards, and profile information. By using the Service, you grant us a limited, non-exclusive licence to store and process that data solely to operate and improve the Service for you.

We do not sell your personal data to third parties. See our Privacy Policy for full details on how your data is handled.

General-tier users may optionally provide their own AI provider API key to enable AI features. You are responsible for the security and usage of any API key you supply. Any costs incurred with a third-party AI provider via your key are your own responsibility, and you must comply with that provider’s terms of service.

The Oracle of Surf name, logo, design, and software are our property. Nothing in these terms grants you any rights to use our trademarks or intellectual property beyond what is necessary to use the Service as intended.

You retain all rights to the content you create (session notes, profile information, etc.).

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of surf sessions, or decisions made on the basis of AI outputs.

Nothing in these terms limits liability that cannot be excluded under Australian consumer law.

You may delete your account at any time from the Profile tab → Danger Zone. Account deletion is permanent and irreversible.

We reserve the right to suspend or terminate accounts that violate these terms, without notice if necessary to protect the Service or other users.

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
